1. Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity, and Bowl & Cup Digital, concerning your access to and use of our digital marketing and web design services. By purchasing our Targeted Landing Page, Google Ads management, Professional Website, or AI System packages, you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, then you are expressly prohibited from using our services and must discontinue use immediately.
2. Intellectual Property and Service Usage
Unless otherwise indicated, the website designs, landing page templates, AI chatbot configurations, and marketing strategies developed by Bowl & Cup Digital are our proprietary property. Upon full payment for services such as our 6-page or 10-page website packages, clients are granted a non-exclusive license to use the delivered digital assets for their business operations. However, the underlying proprietary code, AI workflows, and automated systems remain the intellectual property of Bowl & Cup Digital.
- Users may not use the services to transmit any material that is unlawful, harassing, libelous, or invasive of another's privacy, particularly when utilizing our AI Chatbot and automated SMS/Email systems.
- Users are prohibited from attempting to reverse engineer, decompile, or disassemble any portion of the custom AI content systems or lead-tracking software provided in our premium packages.
- Users may not use the provided Google Ads research, keyword lists, or ad copy for any purpose other than the specific campaign managed by Bowl & Cup Digital without prior written consent.
3. Disclaimer and Limitation of Liability
Our services are provided on an AS-IS and AS-AVAILABLE basis. While we strive for high-converting designs and effective Google Ads management, Bowl & Cup Digital does not guarantee specific financial outcomes, lead volumes, or search engine rankings. We are not liable for any direct, indirect, or incidental damages resulting from service interruptions, hosting downtime, or the performance of third-party platforms like Google Ads. Ad spend is paid directly to Google and is subject to their specific refund policies, independent of our management fees.
4. Governing Law, Modifications, and Contact
These Terms and Conditions and your use of our services are governed by and construed in accordance with the laws applicable to the business registration of Bowl & Cup Digital, without regard to its conflict of law principles.
Bowl & Cup Digital reserves the right to modify these terms at any time to reflect changes in our service offerings, such as updates to our AI systems or hosting protocols. We will notify users of any changes by updating the 'Effective Date' of these terms. For inquiries regarding our web design packages, revisions, or hosting services, please contact us directly through our official communication channels. Your continued use of our services after such changes constitutes your acceptance of the new terms.
